Terms of Service

1. Introduction

These Terms of Service ("Terms") govern your use of services provided by Sheen Landing, a property management and rental services company registered in the United Kingdom. By engaging our services or using our website, you agree to be bound by these Terms.

2. Services Provided

Sheen Landing provides the following property-related services:

3. Client Obligations

3.1 Landlord Obligations

As a landlord using our services, you agree to:

  • Provide accurate information about your properties
  • Ensure all required safety certificates are current and valid
  • Maintain appropriate landlord insurance coverage
  • Comply with all relevant UK landlord legislation
  • Provide access to properties for inspections and maintenance
  • Pay our fees and charges as agreed
  • Notify us of any changes in property ownership or status

3.2 Tenant Obligations

As a tenant applying through our services, you agree to:

  • Provide accurate and complete information in applications
  • Submit to background and credit checks as required
  • Provide valid identification and right to rent documentation
  • Pay rent and deposits as outlined in tenancy agreements
  • Maintain properties in good condition
  • Report maintenance issues promptly
  • Allow access for inspections and repairs with proper notice

4. Property Management Terms

4.1 Management Fees

Management fees are calculated as a percentage of monthly rental income and are payable monthly. Fees are deducted from rental payments before remittance to landlords. Current fee structures are available upon request and may be subject to annual review.

4.2 Tenant Finding Fees

Tenant finding fees are one-time charges payable upon successful placement of a tenant. Fees are due regardless of subsequent tenancy duration, subject to our tenant guarantee terms.

4.3 Maintenance and Repairs

We coordinate maintenance and repairs through our approved contractor network. Emergency repairs may be authorized without prior landlord approval to prevent property damage or ensure tenant safety. All non-emergency work over £150 requires landlord approval unless otherwise agreed.

5. Financial Terms

5.1 Rent Collection

We collect rent on behalf of landlords and remit payments monthly, less our management fees and any authorized expenses. Rent arrears are pursued in accordance with our collections policy and relevant UK legislation.

5.2 Deposit Protection

All tenancy deposits are protected in accordance with UK tenancy deposit legislation. We act as the scheme administrator and handle deposit disputes through the appropriate dispute resolution service.

5.3 Client Account Management

Client funds are held in separate trust accounts and are not mixed with our business funds. Monthly statements are provided detailing all transactions and account balances.

6. Liability and Insurance

6.1 Our Liability

Our liability is limited to the extent permitted by law. We maintain professional indemnity insurance and public liability coverage. Our maximum liability for any claim is limited to £100,000 or 12 months of management fees, whichever is greater.

6.2 Client Insurance

Landlords must maintain appropriate building and landlord insurance. We recommend legal expenses insurance for tenancy-related legal costs. We cannot be held liable for losses that would be covered by appropriate insurance.

6.3 Excluded Liability

We are not liable for:

  • Consequential or indirect losses
  • Loss of rental income due to tenant default (beyond reasonable collection efforts)
  • Property damage not caused by our negligence
  • Legal costs not agreed in advance
  • Market fluctuations affecting property values

7. Data Protection and Privacy

We process personal data in accordance with UK GDPR and our Privacy Policy. By using our services, you consent to necessary data processing for service delivery, including credit checks, reference verification, and legal compliance requirements.

8. Termination

8.1 Termination by Client

Clients may terminate our services with 30 days' written notice. Fees are payable up to the termination date, plus any costs incurred in transferring responsibilities. Early termination may incur additional charges for work in progress.

8.2 Termination by Us

We may terminate services immediately in cases of:

  • Non-payment of fees
  • Breach of these Terms
  • Illegal activity or fraud
  • Failure to comply with legal obligations

9. Complaints Procedure

We are committed to providing excellent service. If you have a complaint:

  1. Contact us directly to discuss the issue
  2. If unresolved, submit a formal written complaint
  3. We will investigate and respond within 15 working days
  4. If still unsatisfied, you may contact relevant regulatory bodies

10. Regulatory Compliance

We operate in compliance with all relevant UK legislation, including but not limited to:

  • Housing Act 2004
  • Landlord and Tenant Act 1987
  • Right to Rent legislation
  • Tenancy Deposit Protection requirements
  • Estate Agents Act 1979
  • Money Laundering Regulations
  • GDPR and Data Protection Act 2018

11. Force Majeure

We are not liable for delays or failures in performance due to circumstances beyond our reasonable control, including but not limited to natural disasters, government actions, labor disputes, or technical failures.

12. Intellectual Property

All content on our website and marketing materials is our intellectual property or used with permission. Clients may not reproduce, distribute, or use our materials without written consent.

13. Governing Law

These Terms are governed by English law and are subject to the exclusive jurisdiction of the English courts. Any disputes will be resolved through the appropriate legal channels in England and Wales.

14. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect. Invalid provisions will be replaced with enforceable alternatives that achieve similar objectives.

15. Amendments

We may update these Terms from time to time. Significant changes will be communicated to existing clients with 30 days' notice. Continued use of our services after changes constitutes acceptance of updated Terms.

16. Entire Agreement

These Terms, together with our Privacy Policy and any specific service agreements, constitute the entire agreement between parties. Verbal agreements or representations are not binding unless confirmed in writing.
